Federal Circuit Revives Dismissed Stanford Patent Suit

Law360 (June 19, 2008, 12:00 AM EDT) -- A patent case brought by Stanford University and delayed for four years should not have been dismissed for failure to prosecute, the U.S. Court of Appeals for the Federal Circuit ruled Thursday.

Judge Terry Hatter of the Central District of California dismissed the case last year. The Federal Circuit found that his order, which consisted of a single sentence, “did not explain the grounds for the court’s decision, nor did it contain any findings of fact.”
