Judge Closes Merck Derivative Suit Over Vioxx

Law360, New York (June 23, 2008, 12:00 AM EDT) -- A New Jersey federal judge has closed a derivative suit filed against Merck & Co. Inc. and its directors for allegedly ignoring health risks associated with painkiller Vioxx after once again denying shareholder plaintiffs' request to amend their complaint against the drugmaker.

U.S. District Judge Stanley R. Chesler of the District of New Jersey ruled on June 17 that proposed amendments by the shareholders would not make the case sound enough to move forward.
