5th Circ. Upholds Extension For Alcoa Power Plant

Law360 (June 25, 2008, 12:00 AM EDT) -- A federal appeals court has upheld a ruling that grants Alcoa Inc. additional time to build eco-friendly power units for its aluminum plant in Rockdale, Texas, despite complaints from citizen groups that the extension violates a consent decree in the case.

On Tuesday, the U.S. Court of Appeals for the Fifth Circuit affirmed a lower court decision extending the deadline and requiring tighter emissions controls for the electricity-generating units after an Alcoa contractor failed to meet the construction time line.
