Court Rules Abbott Glucose Strip Patent Invalid

Law360 (June 25, 2008, 12:00 AM EDT) -- A district court ruled on Monday that an Abbott Laboratories patent related to blood-glucose test strips is invalid and unenforceable, dealing a blow to the company in an infringement lawsuit against several competitors including Bayer Healthcare LLC.

Judge William Alsup of the U.S. District Court for the Northern District of California ruled following a bench trial that four claims of U.S. Patent Number 5,820,551 were invalid due to obviousness, and that the patent was unenforceable due to inequitable conduct.
