Court Certifies Pharmacy Class In AWP Suit V. Eckerd

Law360, New York (June 27, 2008, 12:00 AM EDT) -- A federal court on Wednesday granted class certification in a breach of contract suit against Eckerd Health Services and a subsidiary, opening the gate for thousands of pharmacies that were inadequately reimbursed for prescriptions according to a weekly rather than a daily average wholesale price.

The certification grants class status to a suit brought by two retail pharmacies in Alabama who filed against EHS and its subsidiary TDI Managed Care Services Inc. in February 2005.
