Sanofi-Aventis' Lovenox Patent Restored on Appeal

Law360, New York (April 10, 2006, 12:00 AM EDT) -- In a surprising turnaround, the U.S. Court of Appeals for the Federal Circuit in Washington, D.C. today restored – for now - French pharmaceutical company Sanofi-Aventis SA’s patent for the blood clot treatment Lovenox.

The about-face rejected a lower court ruling that invalidated Sanofi-Aventis’ patent for the anticoagulant in favor of defendants Amphastar Pharmaceuticals Inc. and Teva Pharmaceuticals USA Inc.

In doing so, the Federal Circuit strengthened Sanofi-Aventis' argument that it did not engage in inequitable conduct at the U.S. Patent and Trademark Office when it...
