Texas Justices Take Up Case Over Houston Clean Air Law

By Alex Wolf (February 20, 2015, 3:26 PM EST) -- The Texas Supreme Court on Friday agreed to hear an appeal seeking to strike down Houston's clean air ordinance, taking up a petition by Exxon Mobil Corp., The Dow Chemical Co. and other energy and industrial companies that filed a lawsuit against the city.

The ordinance requires pollution-emitting entities to register with the city and pay a fee, but the group of companies argued in its July appeal that such rules are preempted by state law because a comprehensive scheme of air regulations has already been adopted by the Texas Commission on Environmental Quality and codified under the Texas Clean Air...
