Fed. Circuit Remands Stent Case Over 'Ambiguity'

Law360 (July 15, 2008, 12:00 AM EDT) -- An inventor's claim that Boston Scientific Corp. and Scimed Life Systems Inc. infringed his patents for intravascular stents was sent back to district court Tuesday, after a federal appeals court decided that the lower court's claim construction order in the case was ambiguous.

The U.S. Court of Appeals for the Federal Circuit found that “the consent judgment under review suffers from two ambiguities. As a result, we conclude that it is appropriate to remand this case to the district court for clarification.”
