Arbitration Best Bet For Consumer Disputes: Study

Law360, New York (July 15, 2008, 12:00 AM EDT) -- Consumers fare better when they fight debt collection disputes in arbitration rather than in court, according to a U.S. Chamber of Commerce study released on Tuesday, the same week lawmakers in the U.S. House of Representatives are to weigh legislation that could clamp down on mandatory arbitration clauses.

About 32% of consumer debtors named in cases that did not settle either won their arbitration hearing or had the claims against them dismissed, while in just over 16% of those cases, consumers succeeded in having the claims...
