SmithKline Beecham Sued For Generic Flonase Delay

Law360, New York (July 16, 2008, 12:00 AM EDT) -- A union health care plan has filed a proposed class action against SmithKline Beecham Corp. for allegedly stalling the approval of a generic version of Flonase, the drugmaker's blockbuster nasal allergy medication.

The suit was filed by IBEW – NECA Local 505 Health & Welfare Plan Tuesday in the U.S. District Court for the Eastern District of Pennsylvania.

In the suit, the welfare plan alleges that GlaxoSmithKline abused the citizen petition process of the federal Food, Drug and Cosmetic Act and violated federal and state antitrust...
