Fed. Circ. Grants Apple's Request To Nix VirnetX Royalty

Law360, New York (February 25, 2015, 7:45 PM EST) -- The Federal Circuit on Tuesday threw out an ongoing royalty Apple Inc. had been ordered to pay VirnetX Inc. for infringing the holding company's network security patents, saying it was tied to a $368 million damages award the appeals court had already vacated.

In a brief order, a three-judge panel granted Apple's motion to vacate the ongoing royalty, siding with the tech giant's position that it was based on a Texas federal jury's 2012 verdict that was tossed last year. VirnetX, a patent-licensing company that acquired the patents at issue from government contractor Science Applications International Corp., did not oppose Apple's instant motion...
