2nd Circ. Overturns NLRB Ruling In N.Y. Mall Case

Law360, New York (July 18, 2008, 12:00 AM EDT) -- A U.S. appeals court has overturned a National Labor Relations Board ruling that allowed local representatives from the Empire State Council of Carpenters union to distribute pamphlets at an upstate New York shopping mall.

The U.S. Court of Appeals for the Second Circuit on Friday granted the Salmon Run Shopping Center LLC's petition for review of the NLRB decision, while denying the board's cross-petition on behalf of the union.
