Judge Delays Overstock Suit Amid Appeals

Law360 (April 27, 2006, 12:00 AM EDT) -- A month after refusing to dismiss Overstock.com’s short-selling lawsuit, a California state judge has put the brakes on the Internet retailer’s upcoming trial against a hedge fund and a research firm, delaying proceedings until the defendants’ appeals have been resolved.

Judge Vernon Smith ruled on Wednesday that discovery in the trial could not move forward until the appeals of hedge fund Rocker Partners LP and research analysts Gradient Analytics Inc. over his earlier refusal to toss out the case had been heard.
