Fed. Circ. Says Sidley Blown Deadline Axes $40M AT&T Appeal

Law360, New York (March 19, 2015, 2:38 PM EDT) -- The Federal Circuit ruled Thursday that AT&T Inc. cannot appeal a $40 million patent infringement verdict against it because its attorneys from Sidley Austin LLP missed the appeal deadline, rejecting the firm's argument that the lower court did not properly notify it when the clock started running.

The appeals court held that Judge Orlando Garcia of the Western District of Texas was correct in 2014 when he barred AT&T from appealing a jury's verdict that the company infringed streaming media patents owed by Two-Way Media LLC.
