Court Narrows Discovery In Gender Suit V. Kyphon

Law360 (July 22, 2008, 12:00 AM EDT) -- Kyphon Inc. has succeeded in limiting the amount of discovery current and former saleswomen can seek in their putative class action alleging gender discrimination against the spinal surgery device manufacturer.

Magistrate Judge Howard R. Lloyd of the U.S. District Court for the Northern District of California on Tuesday granted Kyphon’s bid for a protective order in part after the company complained that the plaintiffs’ requests went beyond an earlier discovery order, especially when they asked for information about individual employees who are not representing the class....
