Asarco Settles Pollution Claim With Timber Company

Law360, New York (July 23, 2008, 12:00 AM EDT) -- As it continues to labor toward reorganization, Asarco LLC has reached a settlement with timber company Wasser & Winters for damages Wasser paid for alleged contamination of the Hylebos Waterway.

Under the agreement, submitted Tuesday for Judge Richard S. Schmidt’s approval in the U.S. Bankruptcy Court for the Southern District of Texas, Wasser establishes a $31,098 unsecured claim against Asarco.

In December 2005, Wasser paid approximately $143,000 to the Commencement Bay Natural Resource trustees to settle damages related to alleged pollution from Wasser’s former log yard...
