9th Circ. Rebuffs Costco's Bid To Toss Managers' OT Win
By Daniel Siegal (March 25, 2015, 6:36 PM EDT) -- The Ninth Circuit on Wednesday rejected Coscto Wholesale Corp.'s bid to toss damages won by two managers who alleged Costco misclassified them as overtime exempt, ruling the trial court didn't err in ignoring Costco's expectation that the managers would spend their time on exempt duties.
In an unpublished opinion, a three-judge panel partially affirmed the trial court's award of damages, upholding the finding that the managers spent more than half of their time on non-managerial duties and affirming the trial court's award for unpaid overtime.
