Texas Committee OKs Bill To Block Local Fracking Bans

Law360, Houston (March 30, 2015, 8:16 PM EDT) -- A Texas House committee on Monday approved a bill that would prevent local governments from imposing regulations like the Denton fracking ban, one week after more than 100 people waited hours to testify during a hearing on the bill.

In a 10-1 vote, the House Committee on Energy Resources approved H.B. 40, a measure sponsored by Rep. Drew Darby, R-San Angelo, that would expressly preempt cities and other political subdivisions from regulating oil and gas operations and limit their ability to enforce setback rules that prevent wells from being drilled within a certain distance of schools and homes.
