Brookdale Senior Living Escapes Whistleblower's FCA Claims

Law360, Los Angeles (April 2, 2015, 5:09 PM EDT) -- A Tennessee federal judge on Wednesday dismissed a False Claims Act suit against a therapy agency and a senior living company, ruling the whistleblower who accused them of Medicare fraud did not provide sufficient evidence to back up the allegations.

In granting the defendants’ motion to dismiss, U.S. District Judge Aleta A. Trauger said Marjorie Prather could not identify specific instances of Medicare fraud committed by Brookdale Senior Living Inc. and its sibling company ARC Therapy Services LLC as required under the False Claims Act....
