7th Circ. Says BIA Ignored Key Bad Atty Claim In Asylum Case

Law360, New York (April 2, 2015, 7:36 PM EDT) -- The Seventh Circuit on Wednesday sided with a Chinese citizen seeking deportation relief based on his belief that he would be persecuted for violating the country’s one-child policy, finding the Board of Immigration Appeals had wrongly ignored claims that his lawyers had botched his case by failing to offer extra evidence.

In its ruling in favor of petitioner Tie Xia Chen, the three-judge appellate panel said the BIA hadn’t adequately addressed Chen’s argument that his former attorneys had fumbled his case by failing to offer evidence...
