DOJ Urges Supreme Court To End Inmate Care Rate Challenge

Law360, Miami (April 8, 2015, 7:13 PM EDT) -- The federal government has urged the U.S. Supreme Court to not grant a small, rural Florida hospital's petition seeking review of whether compensation regulations for care the hospital provides federal inmates under the Emergency Medical Treatment and Active Labor Act constitute an unconstitutional taking, saying case law is clear.

Baker County Medical Services Inc., which operates the 25-bed Ed Fraser Memorial Hospital, brought the suit in 2012, asking for declaratory judgment and seeking to recover about $77,000 from the U.S. Marshals Service and $289,000 from U.S. Immigration and Customs Enforcement, should the court rule in its favor.
