Plaintiffs Can Refile In Kitchen, Bath Case: 3rd Circ.

Law360, New York (July 30, 2008, 12:00 AM EDT) -- Plaintiffs who accused a slew of kitchen and bath manufacturers of price-fixing have obtained the right to refile their claims, after an appellate court ruled the lower court incorrectly handled the dismissal of the case.

The U.S. Court of Appeals for the Third Circuit on Monday vacated a lower court's decision to strike the plaintiffs' notice of dismissal in the case, finding instead that the complaint should be dismissed without prejudice.
