2nd Circ. Nixes Arbitration In Nokia-InterDigital Case

Law360, New York (July 31, 2008, 12:00 AM EDT) -- A federal judge should not have ordered arbitration in a patent dispute between InterDigital Inc. and Nokia Corp., the U.S. Court of Appeals for the Second Circuit has ruled, finding that Nokia waived its right to arbitration in the case.

The appeals court on Thursday reversed the March order by U.S. District Judge Deborah Batts of the Southern District of New York, which ordered arbitration and blocked InterDigital from taking a patent infringement action against Nokia before the U.S. International Trade Commission.
