Fed. Circ. Reverses Part Of Sunglass Patent Case

Law360, New York (August 1, 2008, 12:00 AM EDT) -- A federal appeals court has reversed a lower court's summary judgment of noninfringement in a patent dispute that Aspex Eyewear Inc. brought against Altair Eyewear Inc. for allegedly infringing its sunglass patents.

The U.S. Court of Appeals for the Federal Circuit ruled Friday that Judge Stephen C. Robinson of the Southern District of New York erred in 2007 when he granted summary judgment in favor of Altair and found that their eyeglasses with detachable magnetic sunglass lenses did not infringe the three Aspex patents at issue....
