CORRECTED: Hospital's Discovery Objections In Humana FCA Suit Nixed

Law360, New York (April 28, 2015, 8:24 PM EDT) -- A Florida federal judge on Monday rejected Plaza Medical Center Corp.'s contention that a magistrate judge's discovery ruling was overly broad, in a suit accusing the hospital and Humana Inc. of violating the False Claims Act by exaggerating patient illnesses.

U.S. District Judge Federico A. Moreno affirmed U.S. Magistrate Judge John J. O'Sullivan's mixed ruling on PMC's motion for a protective order, rejecting the hospital's appeal of the magistrate decision. PMC's appeal had taken issue with the five-year scope of discovery and with the request for some patients' medical records.
