Judge Nixes Class Cert. In Spectrum Brands FLSA Suit

Law360, New York (August 4, 2008, 12:00 AM EDT) -- A federal judge has denied a motion for conditional collective action certification in a wage-and-hour suit against consumer products company Spectrum Brands Inc. because the current and former employees could not sufficiently prove that they were similarly situated.

U.S. District Judge Michael J. Reagan of the Southern District of Illinois handed down the order on July 31, in a case against the global chemical company that alleges violations of the Fair Labor Standards Act at Spectrum's St. Louis County, Mo., plant.
