N.J. High Court Makes Exception For Suing Counsel

Law360 (August 5, 2008, 12:00 AM EDT) -- A New Jersey appeals court has given the go-ahead to a lawsuit in which a plaintiff sued his attorney for alleged malpractice that he says was a relevant factor behind his decision to settle earlier litigation.

The July 30 ruling in Hernandez v. Baugh is the latest case in which the state's appeals courts have found exception to the 2005 decision that said litigants who are not pleased with settlements to which they agreed cannot sue their lawyers for malpractice.
