Judge Orders EPA To Explain Calif. FOIA Denial

Law360, New York (August 6, 2008, 12:00 AM EDT) -- As the state of California spars with the U.S. Environmental Protection Agency over emissions standards, a federal judge has ordered the agency to explain why it withheld documents related to the rejection of a California request to carry out its Clean Cars Law.

Judge Samuel Conti ruled on Friday in the U.S. District Court for the Northern District of California that the EPA must produce a Vaughn Index outlining the reasons for failing to fulfill California's Freedom of Information Act request.
