Intellectual Ventures Banking Patents Survive Alice Test

Law360, New York (May 12, 2015, 7:07 PM EDT) -- A special master determined Tuesday that two mobile banking patents held by Intellectual Ventures LLC are legitimate, recommending that a Maryland federal court dismiss arguments filed in the infringement and antitrust case by defendant Capital One Financial Corp.

In the face of cross motions for summary judgment on Patent Numbers 6,546,002 and 7,984,081, Raphael V. Lupo found that Intellectual Ventures' use of the mobile interface to achieve the goal of its invention meant that they are not abstract ideas.
