DOE Tax Credits Violate Environmental Law: Suit

Law360, New York (August 13, 2008, 12:00 AM EDT) -- Two nonprofits have accused the U.S. Department of Energy and the U.S. Department of the Treasury of violating environmental protection and endangered species laws when it agreed to direct $1 billion in tax credits toward nine experimental coal-based energy projects.

Appalachian Voices and Canary Coalition lodged an amended complaint against the two departments in the U.S. District Court for the District of Columbia on Tuesday, adding new claims to their original allegation that the government breached the National Environmental Policy Act.
