Blue Cross Sued For Denying Gilead Hep C Drug Coverage

By Dani Kass (May 28, 2015, 7:37 PM EDT) -- Blue Cross and Blue Shield of Florida Inc. wrongfully denied policyholders Gilead Sciences Inc.'s newly approved yet expensive treatment for hepatitis C, according to a putative class action filed Wednesday in Florida federal court.

The insurance company refused its contractual duty to provide coverage for medically necessary treatments for Janie Kondell, who has had hepatitis C for 10 years — and others in similar positions — because her "liver had not sufficiently deteriorated," the suit claims.

"In other words, defendant decided that Ms. Kondell hadn't suffered enough, and her liver hadn't been damaged enough, by a disease that causes irreparable harm...
