Privacy Group Urges DC Circ. To Mull Drone Rules Challenge

Law360, Washington (June 1, 2015, 6:48 PM EDT) -- A privacy watchdog group has urged the D.C. Circuit to hear its case challenging the Federal Aviation Administration drone rules, saying its complaint deserves a hearing because it was appealing a petition the FAA had denied, not an agency rule.

In a Thursday brief opposing the FAA's motion to dismiss the challenge, the Electronic Privacy Information Center said a notice of proposed rulemaking made clear the agency was ignoring the group's petition to initiate privacy rulemaking regarding commercial use of small unmanned aerial systems, despite an earlier letter saying the rule would address privacy concerns.
