Judge Sends Panda Energy Packing Again

Law360, New York (August 15, 2008, 12:00 AM EDT) -- A federal judge has knocked down a bid by Panda Energy International Inc. to revive a securities fraud case against Calpine Corp. that began long before the energy giant ducked into bankruptcy.

On Wednesday, U.S. District Judge Jane Boyle granted Calpine's request to dismiss the plaintiffs' claims, ignoring their tries for a second chance to re-plead their charges.

“Defendants' May 2008 Motion to dismiss (1) Plaintiffs' Federal and State Securities Law Claims; and (2) Plaintiffs' "Financial Strength" Common Law Fraud Claims is granted,” the opinion read....
