High Court Ruling In LabCorp Looms

Law360 (May 22, 2006, 12:00 AM EDT) -- As the U.S. Supreme Court continues to analyze nuances of IP law, a ruling is expected soon on the touchy appeal of Laboratory Corp. of America v. Metabolite Laboratories, in which the Court will tackle subject-matter patentability.

In the so-called LabCorp case, the Justices will decide whether or not a patentee can claim the right to a basic scientific relationship, when that relationship correlates certain test results to a medical condition.
