Sanofi Faces Antitrust Suit Over Lovenox Contracts

Law360, New York (August 21, 2008, 12:00 AM EDT) -- Eisai Inc. has filed an antitrust suit claiming that Sanofi-Aventis' contracts for the anti-coagulant drug Lovenox allow the pharmaceutical giant to maintain an illegal stronghold on the market, leaving just 10 percent market share for competitors.

In a complaint filed Monday in the U.S. District Court for the District of New Jersey, Eisai accuses Sanofi-Aventis of violating U.S. antitrust laws with a contract provision that requires hospitals to buy 90 percent of their anti-coagulant drugs from Sanofi-Aventis in order to obtain a discount.
