Calif. Need Not Pass New Pesticide Rules: 9th Circ.

Law360, New York (August 21, 2008, 12:00 AM EDT) -- A federal appeals court has ruled that the state of California is not obligated to pass new rules on pesticide emissions in order to comply with the Clean Air Act, overturning an earlier decision by a district court.

The suit was originally filed by a community coalition known as El Comite para el Bienestar de Earlimart, among other groups, against California's Department of Pesticide Regulation, Environmental Protection Agency and other state agencies in 2004.
