Ex-Merrill Adviser Wins Arbitration Dispute Appeal

Law360, New York (August 25, 2008, 12:00 AM EDT) -- An Ohio state appeals court on Thursday overturned a lower court's decision to compel arbitration in a lawsuit over an ex-Merrill Lynch adviser's allegations that his former employer fired him because of his attention deficit hyperactivity disorder.

Judge Patricia Ann Blackmon, writing for the Court of Appeals of Ohio for the Eighth Appellate District, remanded the case and held that the trial court had erred in granting Merrill Lynch's motion to compel arbitration in the suit because of a 1999 change in National Association Of Securities...
