Bayer, Others To Get Fees, Costs In Abbott Suit

Law360, New York (August 25, 2008, 12:00 AM EDT) -- A federal judge has issued a harsh rebuke to Abbott Laboratories, ruling that the company's lawsuit over one of four patents covering test strips used to monitor blood glucose levels was an “exceptional case” that warranted an award of fees and costs to co-defendants Bayer Healthcare LLC, Becton Dickinson & Co. and Nova Biomedical Corp.
