No Early Judgment Against ING Bank In FLSA Suit

Law360, New York (August 27, 2008, 12:00 AM EDT) -- A purported Fair Labor Standards Act class action against ING Bank fsb will meander its way to trial, a federal judge ruled Tuesday, refusing to resolve the matter in favor of the plaintiffs, who allege that the bank failed to pay them overtime compensation and benefits due under a severance agreement.

Judge Joseph J. Farnan Jr. of the U.S. District Court for the District of Delaware denied the plaintiffs' motion to dismiss the bank's counterclaims and also denied the plaintiffs' bid for judgment on the pleadings....
