N.Y. Court Issues Preliminary Injunction on Generic Wellbutrin

Law360 (December 29, 2003, 12:00 AM EST) -- The U.S. District Court for the Southern District of New York replaced the temporary restraining order it had issued on Nov. 26, 2003 with a preliminary injunction to prevent Eon Labs from introducing Bupropion, the generic equivalent of GlaxoSmithKline’s antidepressant Wellbutrin.

In addition, the Court set the amount of the bond GlaxoSmithKline is required to post at $3 million. The bond will be used to compensate Eon for any damages it suffers if the preliminary injunction is determined to have been improperly granted.
