2nd Circ. Upholds Ruling In Suncoast Kickback Case

Law360 (August 29, 2008, 12:00 AM EDT) -- An appeals court has affirmed a district judge's decision not to afford a new trial to three men found liable in a securities fraud case involving Suncoast Capital Group Ltd. and New York Life Insurance Co. Inc.

In a decision Wednesday, a three-judge panel of the U.S. Court of Appeals for the Second Circuit said that a district court was correct in allowing a U.S. Securities and Exchange Commission witness to testify in the case of David A. Zwick, Todd J. Cohen and Terrence J. O'Donnell....
