Some Antitrust Allegations Against Avaya Upheld

Law360 (September 2, 2008, 12:00 AM EDT) -- A judge has allowed counterclaims of monopolization, attempted monopolization and illegal conspiracy against leading phone maintenance company Avaya Inc. but dismissed some other counterclaims by a competing maintenance firm.

Tying counterclaims with respect to software patches and upgrades as well as counterclaims that Avaya set out with the intent to create a monopoly were thrown out in the case in U.S. District Court for the District of New Jersey.
