Some Antitrust Allegations Against Avaya Upheld

Law360, New York (September 2, 2008, 12:00 AM EDT) -- A judge has allowed counterclaims of monopolization, attempted monopolization and illegal conspiracy against leading phone maintenance company Avaya Inc. but dismissed some other counterclaims by a competing maintenance firm.

Tying counterclaims with respect to software patches and upgrades as well as counterclaims that Avaya set out with the intent to create a monopoly were thrown out in the case in U.S. District Court for the District of New Jersey.

Avaya’s original lawsuit accuses Continuant of illegally using proprietary passwords to access telephone systems and provide maintenance....
