Strip FTC Of Merger Review Power, Panelists Demand

Law360 (June 1, 2006, 12:00 AM EDT) -- The Federal Trade Commission should be stripped of its power to review mergers, with the responsibility consolidated under the U.S. Department of Justice, a dissenting minority of the Antitrust Modernization Commission has proposed.

The suggestion was made during the AMC’s most recent meeting, held last week, as the Commission debated ways to improve the often cumbersome and time-consuming merger review process.

The merger review process, notably the second request system, has long been the source of frustration for companies and regulators alike.
