Engineering Co. Fights Coverage Exclusion In 5th Circ.

Law360, New York (July 23, 2015, 10:08 PM EDT) -- An engineering company urged the Fifth Circuit on Thursday to reverse a ruling that Hartford Casualty Insurance Co. has no duty to defend or indemnify it in litigation over a fatal crane accident at an Arkansas nuclear power plant, contending that the lower court applied an overbroad interpretation of a professional services exclusion.

DP Engineering LLC and employee John Scroggins asserted in an appellate brief that U.S. District Judge John McBryde was wrong to grant summary judgment to Hartford and affiliate Hartford Lloyds Insurance Co. on the basis of the various professional services exclusions in the insurers' policies.
