7th Circ. Affirms Ruling In Favor Of Exelon Union

Law360, New York (September 4, 2008, 12:00 AM EDT) -- A federal appeals court panel ruled Tuesday that a labor union can represent retirees in an arbitration dispute with electric utility Exelon Corp. over medical benefits.

In affirming a lower court decision, the U.S. Court of Appeals for the Seventh Circuit found that nothing in the collective bargaining agreement expressly prevents the union, Local 15 of the International Brotherhood of Electrical Workers, from representing retirees.
