TTAB Rips Fross Zelnick's 'Unreasonable' Response To Typo
Law360, New York (July 27, 2015, 3:57 PM EDT) -- The Trademark Trial and Appeal Board issued a scathing opinion last week that blasted attorneys at Fross Zelnick Lehrman & Zissu PC for using an "obvious" typographical error in a discovery request as "an excuse to become pedantic, unreasonable and uncooperative."
The harshly worded rebuke came in a dispute over Cadbury UK Ltd.'s "Bournvita," a decades-old brand of malted chocolate drinks that is no longer marketed in the U.K. but remains a big seller in India, Nigeria and several other developing countries.
