Carpenter Seeks New Trial Over $11M Cleanup Bill

Law360, New York (September 9, 2008, 12:00 AM EDT) -- A month after a federal court ordered Carpenter Technology Corp. to pay roughly $11 million in environmental cleanup costs incurred by Ford Motor Co. and four other plaintiffs, the specialty alloys maker is seeking a new trial, decrying the $7 million “windfall” the plaintiffs stand to receive under the judgment.

Carpenter requested a new trial Monday, claiming the court’s judgment overshoots the $13 million the plaintiffs paid to decontaminate the Boarhead Superfund site because they have already collected approximately $10 million in settlements with other defendants....
