AutoZone Can Gear Up Again For Trademark Suit

Law360, New York (September 12, 2008, 12:00 AM EDT) -- Automotive parts giant AutoZone Parts Inc. scored a victory Thursday when an appeals court revived its lawsuit accusing Strick Enterprises Inc. of infringing on the trademark “AutoZone” in violation of the Lanham Act and several Illinois laws.

A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit reversed a lower court's grant of summary judgment to the Chicago-area Strick auto shop, which used the allegedly infringing marks “Oil Zone” and “Wash Zone,” and said the case should not have been dismissed.
