Foreign Oil Firms Must Face NJ Pollution Suit

Law360, New York (September 15, 2008, 12:00 AM EDT) -- A Spanish oil conglomerate and its Argentinean subsidiary cannot be excused from a lawsuit brought by the state of New Jersey over their alleged discharge of pollutants into the Passaic River, a state superior court has ruled.

The New Jersey Department of Environmental Protection and Occidental Chemical Corp., a co-defendant in the litigation, had met their burden to establish personal jurisdiction over Spain's Repsol YPF SA and Argentina-based YPF SA, the Superior Court of New Jersey for Essex County ruled on Monday.
