BMS Sues Abbott Over Baby Formula Container Patent

Law360 (September 16, 2008, 12:00 AM EDT) -- Bristol-Myers Squibb Co. has accused Abbott Laboratories of infringing a patent for a baby formula container.

In a complaint filed Monday in the U.S. District Court for the Southern District of Indiana, BMS and subsidiary Mead Johnson & Co. claim Abbott's new Similac SimplePac container infringes BMS' patent, U.S. Patent Number 7,040,500, which was issued in May 2006 and covers a container with an attached scoop.
